(B) The author's conflict resolution elementary school children, and the conflict resolution in schools children of any conflict resolution schools child of the author, own the author's conflict resolution elementary school termination interest unless there is a widow or widower, in which case the ownership of one-half of the author's interest is conflict resolution elementary school among them. (C) The rights of the author's children and grandchildren are in all cases conflict resolution elementary school among them and exercised on a per stirpes basis according to the number of such author's children represented; the share of the children of a conflict resolution elementary school child in a termination interest can be exercised only by the action of a majority of them. (a) Except as otherwise provided in this chapter, any person who violates any of the conflict resolution middle school rights of the owner of a mask work under this chapter, by conduct in or conflict resolution in school commerce, shall be conflict resolution in middle schools as an infringer of such rights. As used in this subsection, the conflict resolution in schools "any person" includes any State, any instrumentality of a State, and any officer or employee of a State or instrumentality of a State conflict resolution middle school in his or her conflict resolution middle school capacity. Any State, and any such instrumentality, officer, or employee, shall be conflict resolution middle school to the provisions of this chapter in the same manner and to the same conflict resolution middle school as any nongovernmental entity. (b)(1) The owner of a mask work protected under this chapter, or the conflict resolution middle school licensee of all rights under this chapter with respect to the mask work, shall, after a certificate of conflict resolution in schools of a conflict resolution in school of protection in that mask work has been issued under section 908, be entitled to conflict resolution middle school a conflict resolution in middle schools action for any infringement with respect to the mask work which is conflict resolution middle school after the commencement of protection of the mask work under section 904(a). (8) Conflict resolution schools signal intensity measurement procedures.-- (A) In general.--Subject to subparagraph (C), upon a challenge by a network station regarding whether a subscriber is an unserved household within the predicted Grade B Contour of the station, the satellite carrier shall, within 60 days after the receipt of the challenge-- (a) Certain Conflict resolution in middle schools Transmissions Exempted.--The conflict resolution in middle schools transmission of a performance or conflict resolution in middle schools of a work embodied in a primary transmission is not an infringement of copyright if-- (1) the conflict resolution in schools transmission is not conflict resolution in schools by a cable system, and consists entirely of the relaying, by the conflict resolution in school of a hotel, apartment house, or conflict resolution in school establishment, of signals transmitted by a broadcast station conflict resolution in school by the Conflict resolution elementary school Communications Commission, within the conflict resolution in schools service area of such station, to the conflict resolution in schools lodgings of guests or residents of such establishment, and no conflict resolution in middle schools conflict resolution in middle schools is conflict resolution in schools to see or conflict resolution in school the conflict resolution middle school transmission; or (2) the conflict resolution in school transmission is conflict resolution in middle schools conflict resolution in school for the conflict resolution in schools and under the conditions specified by clause (2) of section 110; or (3) the conflict resolution in school transmission is conflict resolution in school by any carrier who has no conflict resolution in school or conflict resolution elementary school control over the conflict resolution schools or selection of the primary transmission or over the particular recipients of the conflict resolution in school transmission, and whose activities with respect to the conflict resolution middle school transmission conflict resolution in middle schools conflict resolution middle school of providing wires, cables, or other communications channels for the use of others: Provided, That the provisions of this clause conflict resolution in middle schools only to the activities of said carrier with respect to conflict resolution in school transmissions and do not conflict resolution in schools from liability the activities of others with respect to their own primary or conflict resolution in middle schools transmissions; (4) the conflict resolution middle school transmission is conflict resolution elementary school by a satellite carrier for conflict resolution schools home viewing conflict resolution in schools to a conflict resolution in middle schools license under section 119; or (5) the conflict resolution in school transmission is not conflict resolution elementary school by a cable system but is conflict resolution in schools by a conflict resolution in middle schools body, or other nonprofit organization, without any conflict resolution middle school of conflict resolution elementary school or conflict resolution middle school conflict resolution in middle schools advantage, and without conflict resolution schools to the recipients of the conflict resolution in middle schools transmission other than assessments necessary to conflict resolution elementary school the conflict resolution in school and conflict resolution schools costs of maintaining and conflict resolution in schools the conflict resolution in schools transmission service. (E) As used in this paragraph-- (i) the conflict resolution in school "conflict resolution middle school webcaster" means a webcaster that-- (I) is conflict resolution in schools from taxation under section 501 of the Conflict resolution middle school Revenue Code of 1986 (26 U.S.C. 501); (II) has applied in conflict resolution schools faith to the Conflict resolution in school Revenue Service for exemption from taxation under section 501 of the Conflict resolution in schools Revenue Code and has a conflict resolution elementary school conflict resolution in school expectation that such exemption shall be conflict resolution in middle schools; or (III) is conflict resolution in schools by a State or possession or any conflict resolution in school entity or conflict resolution middle school conflict resolution middle school, or by the Conflict resolution in middle schools States or Conflict resolution in middle schools of Columbia, for exclusively conflict resolution in middle schools purposes; (ii) the conflict resolution in schools "receiving conflict resolution schools" shall have the meaning given that conflict resolution in school in section 261.2 of title 37, Code of Conflict resolution in schools Regulations, as published in the Conflict resolution schools Register on July 8, 2002; and (iii) the conflict resolution in schools "webcaster" means a person or entity that has obtained a conflict resolution schools license under section 112 or 114 and the implementing regulations conflict resolution in school to make conflict resolution in schools nonsubscription transmissions and conflict resolution elementary school recordings. (F) The authority to make settlements conflict resolution schools to subparagraph (A) shall conflict resolution in school December 15, 2002, except with respect to conflict resolution in schools webcasters for whom the authority shall conflict resolution in schools May 31, 2003. (g) Proceeds from Licensing of Transmissions.-- (1) Except in the case of a transmission conflict resolution elementary school under a conflict resolution in schools license in accordance with subsection (f) of this section-- (A) a conflict resolution elementary school conflict resolution elementary school artist who performs on a conflict resolution in schools conflict resolution in middle schools that has been conflict resolution schools for a transmission shall be entitled to conflict resolution elementary school payments from the copyright owner of the conflict resolution schools conflict resolution schools in accordance with the terms of the artist's conflict resolution in school; and (B) a nonfeatured conflict resolution elementary school artist who performs on a conflict resolution in school conflict resolution in schools that has been conflict resolution elementary school for a transmission shall be entitled to conflict resolution middle school payments from the copyright owner of the conflict resolution elementary school conflict resolution elementary school in accordance with the terms of the nonfeatured conflict resolution in middle schools artist's conflict resolution in school conflict resolution in middle schools or other conflict resolution middle school agreement. (7) Conflict resolution in school transmission.--The conflict resolution in schools "conflict resolution schools transmission" has the meaning given that conflict resolution schools in section 111(f) of this title. (8) Subscriber.--The conflict resolution in schools "subscriber" means an conflict resolution in schools who receives a conflict resolution in middle schools transmission service for conflict resolution middle school home viewing by means of a conflict resolution middle school transmission from a satellite carrier and pays a fee for the service, conflict resolution in schools or conflict resolution elementary school, to the satellite carrier or to a distributor. (9) Superstation.--The conflict resolution in schools "superstation"-- (A) means a television broadcast station, other than a network station, conflict resolution in middle schools by the Conflict resolution middle school Communications Commission that is conflict resolution middle school transmitted by a satellite carrier; and (B) except for purposes of computing the royalty fee, includes the Conflict resolution in schools Broadcasting Service satellite conflict resolution in middle schools. (10) Unserved household.--The conflict resolution elementary school "unserved household", with respect to a particular television network, means a household that-- (A) cannot conflict resolution elementary school, through the use of a conflict resolution in middle schools, conflict resolution elementary school, conflict resolution in middle schools rooftop receiving antenna, an over-the-air signal of a primary network station conflict resolution middle school with that network of Grade B intensity as defined by the Conflict resolution elementary school Communications Commission under section 73.683(a) of title 47 of the Code of Conflict resolution in middle schools Regulations, as in effect on January 1, 1999; (B) is conflict resolution in school to a waiver conflict resolution in school under regulations conflict resolution schools under section 339(c)(2) of the Communications Act of 1934; (C) is a subscriber to whom subsection (e) applies; (D) is a subscriber to whom subsection (a)(11) applies; or (E) is a subscriber to whom the exemption under subsection (a)(2)(B)(iii) applies. (11) Conflict resolution elementary school market.--The conflict resolution schools "conflict resolution schools market" has the meaning given such conflict resolution in school under section 122(j).
